Making a Will during Lockdown

The global pandemic has highlighted just how uncertain life can be, with the world as we know it drastically different from where we started 2020.

It has also made us realise just how important it is to plan for the future, because we really don’t know what is around the corner. Demand for Wills have increased by 70% since the start of lockdown, with more people making steps to plan for their future to ensure that their wishes are made clear. Can I make a Will during lockdown?

Yes, absolutely! At Damsons Estate Administration we are committed to maintaining exceptional service. All Will appointments take place over the phone or face-to-face through Zoom to ensure the safety of our clients and team.

Be assured that all Wills made over the phone are of the same high quality and validity as those made in law firms offices. Appointments usually take less than an hour to complete, with a professionally printed Will posted to you in a presentation folder. All you need to do then is get it signed.

But what about Witnessing?

By law, a Will needs to be witnessed by two people to become a legally binding document. However, with local lockdowns, self-isolation and shielding, this has become increasingly difficult to complete for some.

As a temporary measure until January 2022, the Government has introduced legislation to permit Wills to be witnessed by video link where physical witnessing is not possible. However, the Ministry of Justice has said “the use of video technology should remain a last resort, and people must continue to arrange physical witnessing of wills where it is safe to do so.”
